Terms of Service

These Terms of Service (“Terms”) govern your visit to cloudelys.com and your purchase of digital products from BloomFrame Studio. By buying or downloading, you agree to these Terms. If you do not agree, do not complete a purchase.

1. Seller identity (US transparency)

We sell downloadable floral design assets and photos (wallpapers, wedding frames, seasonal bundles). We are not EVOXEN LLC or any other company under that name. A telephone number is not required for this digital storefront; email support is the primary contact channel for download and license help.

2. Digital goods only — accurate product description

All products are ready-made downloadable digital files (typically JPG and/or PNG inside a ZIP archive, plus LICENSE.txt / README) in the category of design assets / photos. No physical goods are sold or shipped. This store is not a generative AI image or video product (no text-to-image or prompt-based generation tools). Exact contents, file counts, license type (personal or commercial), and pack size are stated on each product page before checkout. Sample previews on product pages are illustrative; the full paid pack is delivered after successful payment.

Prices are one-time (not subscriptions) unless a product page clearly states otherwise. Taxes or fees charged by the payment provider, if any, will appear at checkout.

4. Payment — Creem as Merchant of Record

Checkout and payment are handled by Creem (creem.io), which acts as Merchant of Record / payment processor for qualifying transactions. That means Creem may appear on your bank or card statement, process your payment, handle certain tax/VAT aspects of the transaction, and often deliver or host the download link.

Refunds, chargebacks, and many payment disputes are handled by Creem as Merchant of Record. Where Creem provides checkout tools, order history, or customer-support flows for payment issues, please use those first. By purchasing, you also agree to Creem’s applicable terms at checkout. BloomFrame Studio provides the product listing, license terms for the files, and post-purchase download and license help at gzwyxc@aol.com.

5. Delivery

After successful payment, you receive an instant digital download (Creem download / email link or equivalent). Keep your confirmation email. If the link expires or fails, contact gzwyxc@aol.com with your order details and we will help restore access to the files you paid for.

Purchase grants a license to use the files as described on the product page and in LICENSE.txt inside the pack — not a transfer of copyright ownership. In summary:

8. EU / EEA / UK consumer right of withdrawal (14 days) & digital-content exception

If you are a consumer in the European Union, EEA, or United Kingdom buying at a distance:

Model withdrawal wording (if still entitled): “I hereby withdraw from my contract of sale of the following digital product: [product name], ordered on [date], order ID [id]. Name: [name]. Email: [email].” Send any still-valid withdrawal notice to Creem as directed by Creem’s buyer terms (and copy gzwyxc@aol.com only if Creem asks for seller confirmation of non-delivery).

10. Intellectual property

Site design, text, and product artwork remain owned by HePing Peng / BloomFrame Studio (or licensed to us). Your purchase only grants the file license in Section 6.

11. Acceptable use

Do not use the files or site for unlawful, fraudulent, hateful, or infringing purposes. Do not attempt to circumvent payment, scrape the site abusively, or attack our systems or Creem’s systems. Do not use our marketing or this site to invent fake reviews, testimonials, or inflated customer counts.

12. Disclaimer & limitation of liability

Except where prohibited by law, products are provided “as is.” We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law. Nothing in these Terms limits mandatory consumer rights in the EU/EEA/UK or elsewhere.

Where liability can be limited: our total liability for any claim related to a specific purchase is limited to the amount you paid for that product. We are not liable for indirect or consequential losses (lost profits, lost data beyond re-supply of the download, business interruption) to the extent permitted by law.

13. Governing law & disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules, except that if you are a consumer in the EU/EEA/UK (or another country with mandatory consumer protections), you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country. EU consumers may also use the European Commission’s Online Dispute Resolution platform where available. Payment-related disputes may also be addressed through Creem’s Merchant of Record processes.

14. Changes

We may update these Terms. The “Last updated” date will change when we do. For ongoing use of the site, the new Terms apply from posting. Completed purchases remain subject to the Terms in force at the time of purchase, plus any mandatory rights that cannot be varied.
